Attorney Laura Devine prevailed on a motion to dismiss on behalf of a landlord against an individual who allegedly fell on the premises and sustained injuries pursuant to Mass. R. Civ. P. 4(j). The action was filed on the eve of the statute of limitations and service was never perfected onto the defendant. After the passage of almost a year with no activity on the case, the Suffolk County Superior Court (Massachusetts) allowed the defendant landlord’s motion to dismiss the action.
